Did You Fall on City Property?

However, pursuant to the Municipal Act (and the City of Toronto Act in Toronto), slip and fall victims are required to report the fall to the municipality where the fall occurred within 10-days. The report must be in writing and must include the date, time, and location of the fall. Failure to put the municipality on notice may result in your claim being statute barred.

Did You Slip and Fall on Private Property?

If you slip and fall on private property, pursuant to the Occupiers’ Liability Act, you are required to notify the occupier of the property within 60-days that the incident occurred. Similar to the reporting requirements identified above, the notice must be in writing and must include the date, time, and location of the fall.
